When I worked as a criminal defense attorney, I was amazed, shocked, and frustrated by the number of judges who were former prosecutors.
Prosecutors believe the criminally accused were always guilty, they never questioned police motives (or misconduct), or that the prosecutorial culture measures its productivity with body counts. While all problematic - it’s magnified when placed in a robe.
Once you’ve held the hand of an incareated person who cannot make bail, sat with a family crying about a loved one, or stood in court alone by the side of a defendant, concepts like bail, search and seizure, and sentencing guidelines move from abstractions to realist frustrations rather quickly. Sadly, few judges come from defense side of the courtroom.
Kentaji Brown worked long enough as a public defender to know how disconnected the criminal justice system is from reality. She will bring a perspective to the Supreme Court that has been absent since the retirement of Thurgood Marshall.
